1Acceptance of Terms

By signing up for an account, accessing, or utilizing the AutoWhapp software, API endpoints, WhatsApp Multi-Device Gateway, or AI automation tools (collectively referred to as the “Service”), you agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of a company or legal entity, you represent that you possess full legal authority to bind such entity. If you do not agree to these terms, you must immediately cease all access and usage of AutoWhapp.

2Strict Anti-Spam & Acceptable Use Policy

AutoWhapp is built exclusively for legitimate business communication, transactional updates, customer service, and permission-based marketing. We maintain a zero-tolerance policy regarding unsolicited communications. You expressly agree to adhere to:

• Explicit Recipient Consent: You may only initiate messages to individuals who have directly and explicitly opted in to receive communication from your organization. Cold messaging purchased lead lists or scraping unknown numbers is strictly prohibited.
• Opt-Out Mechanism: All automated promotional campaigns must provide a simple, automated opt-out keyword (e.g., “Reply STOP to unsubscribe”).
• WhatsApp Terms Compliance: Your usage must strictly respect WhatsApp’s official Terms of Service and Business Messaging Policies.
• Prohibited Content: You will not transmit fraudulent content, adult materials, cryptocurrency scams, illegal pharmaceuticals, gambling promotions, hate speech, malware, or harassment.

3Account Integrity, API Keys & Multi-Device Sessions

When linking your WhatsApp numbers via our QR pairing system or generating REST API credentials:

• You are responsible for maintaining the confidentiality of your API keys and dashboard credentials.
• You retain sole custody and physical authority over the phone numbers linked to AutoWhapp.
• AutoWhapp provides a real-time session manager that lets you unlink or terminate any active WhatsApp device session instantly with one click.

4WhatsApp Account Suspension & Ban Disclaimers

AutoWhapp incorporates state-of-the-art anti-detection safeguards, including our Humanizer delay engine (10-30s randomized intervals), realistic typing simulations, and automatic campaign pausing. However:

5AI Agent Fleet & LLM Provider Integration

AutoWhapp allows you to connect cutting-edge Large Language Models (including Groq, Google Gemini, DeepSeek, and OpenAI). When utilizing AI automated responses:

• You are responsible for reviewing and verifying the system prompts, business FAQs, and knowledge guidelines provided to your AI agents.
• You agree not to bypass, abuse, or use AI auto-replies to generate harmful, misleading, or defamatory advice.
• We do not utilize your private customer conversations to train public machine learning models.

6Subscription, Billing & Refund Policy

AutoWhapp offers tiered subscription plans (Free, Pro, Business, Enterprise) billed monthly or annually.

• 14-Day Money-Back Guarantee: If you experience technical defects or service incompatibilities within 14 days of your initial paid upgrade that our engineering team cannot resolve, you are entitled to a full 100% refund.
• Cancellation Anytime: You may cancel recurring billing at any time from your account settings. Cancellation stops future renewals immediately.

7Intellectual Property & License

The AutoWhapp platform, source code, visual branding, trademarks, algorithms, and documentation are the exclusive intellectual property of AutoWhapp Technologies & Lucky Kuntal. You are granted a limited, non-exclusive, revocable license to access the platform for your internal business operations. You retain 100% full ownership over your customer contact directories, message payloads, and uploaded media.

8Limitation of Liability & Indemnification

To the maximum extent permitted by applicable law, in no event shall AutoWhapp, its founder Lucky Kuntal, or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or third-party service interruptions (such as Meta server outages or protocol updates).

Our aggregate liability for any claims arising out of or relating to these Terms shall not exceed the total amount paid by you to AutoWhapp during the three (3) months preceding the incident.

9Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute or claim arising out of or in connection with these Terms shall first be resolved through good-faith mutual negotiations.
